Maybe this is a stupid question but here goes. Why in some diagrams is the tone cap soldered to the volume pot and in others it is soldered to one leg of the tone pot and the pot itself?

Because there is more than one way to skin a cat. I prefer the tone pot connections...a lot of Gibsons use the cap to connect pots though...

There are many spots which you can solder stuff to and it is exactly the same thing.... for example for ground you can solder to the back of the pot or you can solder to one of the legs of the pot that at the same time is already soldered to the back of the pot or you can solder to any of the backs of any pot ..... :)
