I have a sales receipt along with emails and phone records of a person that traded two late 90's Fender Deluxe Super Strats to me. The part that has my worried is one of them has the serial number scratched off. The seller claims that his guitar tech bought it that way years ago and sold it to him like that. I did remove the neck and there was a bar code label still inside. Is there anyway to retrieve a serial number through that?

I have to pull the neck again to get the bar code. I just want to clear up the ownership of this guitar.

Why scratch serial number if not a stolen guitar ?

Who steal the guitar ? The seller or his tech ?

The barcode on the neck will not reveal the serial number.
It is used by fender for part numbering.
If you know the model you can look up the fender PDF but only if Fender have listed the PDF for that model.
All the parts for each model have a number in that list and the neck number will be there so you can cross reference neck to model.

Of course there is probably a neck date as well.
The removal of a serial number is suspicious and is frowned upon. :D

Trust me, I know its bad mojo to have serial number-less Stratocaster. I really wish it wasn't that way. It makes it unmarketable, I need to clear up its ownership, but I've placed ads in CL looking for possible owner, so far no one has come forward. ...

Happily, I've never been in that situation and haven't considered the legal problems. :|

Should an instrument be proven to be stolen, would the original owner retrieve his goods without further compensation.

It would seem so, but I'm not a lawyer. Happily :D

You should contact the local Police, they can search their burglary records to see if it's on a Hot List.

If stolen, the owner could recover the guitar from you w/o compensation, but not without going to court.

Keep any receipts or Trade Agreement so you can't be charged for being in possession of Stolen Goods.

If you do all that, then after 6 mos. I wouldn't worry about it.

Depending on how badly scratched it is, try putting a light piece of paper over the serial number and lightly rub a pencil over it, maybe the numbers will appear, and then you can do the legal thing. :)

Don't pay attention to the dumas saying put paper over the lack of serial number. It's been gouged off with a dremel tool or chisel. He'd have seen that if he went to your photobucket page. You'll get a copy of your gouge marks. Without a serial number, it's your guitar.....period. Enjoy but don't cry over the original owner losing the guitar. I've known people (they're clean n sober now) who had bought guitars on credit n when the dope n booze ran out defaced the serial # n reported it stolen. Ain't saying that's what happened but....no legible serial #, no crime... I've had a number of axes stolen over the years I my advice, say a prayer for the wrong doers.....that they get run over....by an express bus....real soon.
