The info you received from Sam Ash sounds correct......with a couple of caveats...or perhaps a bit more explanation, I suppose.
Finishes are pretty subjective, so what we are talking about depends upon a number of things. I'll take the risk of being flamed and say that most guitars that have been polished will have swirl marks to one degree or another. However, the visability of swirl marks on, let's say...a pearl white guitar will not show up very well...if at all...while in all liklihood, a black finish will show them in all their glory. The arm's length, in normal lighting, is a fair way for guitar finishes to be viewed at. Contrary to what is being stated in previous posts, my experience with car finishes (which I never noticed until I worked here), is that if you look as closely at your car's finish as it appears you may be looking at the guitar's, you will not only see swirls, but a good amount of "orange peel" as well.

Obviously, the degree of the swirls is really the important part. If, compared to other guitars in the same or similar colors, and in the same lighting conditions as you describe, the swirls seem excessive, than it may be that whoever polished the guitar may have pushed too hard on the buffer, or the buffer cloth was not as clean as it should have been.
So the question really becomes...would a replacement be better and solve the issue or would it not? Is the finish of lower quality than like instruments or is it not?

The advice on Polishes given is good advice....I understand that our new Custom Shop polish is being endorsed by every Master Builder that has used it.

I just got a response back from Fender:

So I guess they're basically saying the same thing. I'm not sure what to do now as I just spoke with Samash and the guitar is out of stock.

Check back with Sam Ash and ask them for a lead time on a replacement.
I believe that most of the stores have service as well and they may be able to buff and polish the problem out. If you haven't sone so already, i would still suggest checking out some other guitars---not necessarily Fenders---just to give the finish on yours a bench mark and see where yours is comparatively. Like anything, once you spot something, its hard to "un-see" it.

Okay I just requested a RMA and the guitar will be returned to Samash. I just bought it again on sweetwaters at a cheaper price and no tax. :)

I was looking at Epiphone Les Pauls at GC a while back and kept noticing poorly sanded necks on a few of them. One was so bad that it had a raised line where no sanding at all had occured. Piss poor quaility for sure. I buy my stuff by going to the place selling them because if there's anything I don't like about it, I won't buy it. Mail order is always a crap shoot at best!
