If you took it to a "luthier" who couldn't solve what sounds like a relatively minor issue, then you need to find a new luthier who knows WTF he's doing.

i agree... but here it's almost impossible to find a good luthier within a 100 km radius

Your problem is with open string ? If yes ;

Your nut slot for this string look to be to low.

Do this test ; fret the string at the third case , look at the string , it should be very very close to the first fret BUT NOT TOUCH IT.
If the string touch the metal 1st fret , the nut slot is too low. If the string do not touche the first fret , your problem is not at the 1st fret.

Find a real luthier not a "nobody" trying to repair guitar. This is a basic repair.

" what should i do?"

If you could clarify and quantify some details, that would be a big help:

" really bad fret buzz on the first fret of the fifth string on my mim "

Do you mean the open unfretted string is buzzing against the first fret? Or are you saying it buzzes when it's fretted at the first fret?

***************

" the action on my guitar can't get any higher "

Do you mean you don't want it any higher? Or do you mean that the saddles are so high that you physically can't raise them any higher?Precisely how high is the action? (The clearance between the bottom of the string and the top of the 17th fret.) How much relief does the neck have? (My brain thinks in inches, but I can deal with mm's if you prefer.)

***************

" i raised the hight on my nut "

How did you do that? Replaced the nut? Filled the string slot with something and then recut the slot? Removed the nut and shimmed it higher, then recut the slots? The temporary diagnostic technique of putting a thin piece of paper in the slot to raise the string?

***************

" i took it to a luthier but it still buzzes there "

If you specifically asked him to fix the buzz, did he offer any explanation why it's buzzing and why he couldn't fix it?
