That's funny. I just had Sentinal make me a Tele logo for my Andy Summers insp. Tele. I was going to leave the headstock blank and keep people guessing, but it always seemed to be in the back of my mind. I also didn't right putting someone elses logo on it. I have two parts-o-casters and never claim them to be anything other than copies.

Barracks lawyers amuse me as well... especially the ones that don't understand that "Trademark" infringement IS illegal..

The "decal" isn't protected, the design, font, and other aspects of their mark is!

If Fender were to allow the use of it's registered marks by just anyone they would LOSE THE RIGHT to use it exclusively on their products...

They MIGHT not catch everyone, but they're certainly going to make an example of anyone who gets noticed...

What is interesting is that Mike Roberts informs us that the company's reach cannot extend outside the US. Thus, the vendor to whom the link was posted operates unimpaired. At the end of the day it is up to each individual as to whether or not the trademark is going to be honored and protected.

So what is going to get the lawyers chasing people then?

Mass produced fake copies intended for massive profit like the type made in China- or the amatuer hobbyist making his dream guitar in a back yard shed?

If outside North America is off limits- then ...is it really illegal outside the US/Canada then? Not saying, but technically that means anywhere else you can get away with it. Which explains why China seems to have an abundance of badly copied start counterfeits- no lawyer can touch the people who do it? International trademark could be a different kettle of fish altogether...

Or am I just reading too far into it.

On the train this morning, I gave your comment to my attorney friend for an opinion. In the matter, if the firm, whose link was posted, sells to a buyer in the US, they then impact on domestic commerce and, under those circumstances, Fender can reach across borders. In the matter of international trademark issues, the laws vary from country to country and can complicate ligitation, but not make it impossible. At the heart of the matter are the laws of supply and demand. That's our obligation.
