Violating a copyright and getting in trouble for it are two separate things.

Notice on Roman's "Fabulous Fakes" pages that a couple of the copyright owners told Ed to cease and desist!

Roman's been making them for a while. If Crash hasn't brought lawyers to Roman's door, maybe he has no problem with Roman making those copies.

I don't think they are exact copys. Look at the different crash guitar paint jobs. Just paint a square puzzel board paint finish in a graffiti style.

Ceri is correct. And artist does not have to apply for a copyright in the US since 1989 when the US finally signed the Berne convention to protect artistic works. The thing with the Crash works are they are graffiti stylized art and very generic in the sense that one can reproduce the look with some variation and if it is not misrepresented you are not infringing on the copyright.
Now if you were to reproduce acopy and sell as original thats different.

Absolutely correct in all respects. This was a subject of conversation on the train this morning and pretty much substantiates CV's observations. The other key factor is the fact that the guitar has a 'use' commodity unlike a work on canvas. This fact alone takes its finish out of the realm of copyright or trademark contention. As long as the 'reproduction' is not represented to be the original, or likewise, anything in that genre as the workproduct of the artist, the issue of fraud is not in contention.
