For the sticking truss rod you can use a small drop of three in 1 oil on the truss rod nut and let it soak in fr a little while before attempting to adjust it. This should loosen the rod if it doesn't then it could be defective.

As the fret issue goes, wait till the rod can be adjusted. Once adjusted if it's still buzzing then there is a host of things to try but if it's new then your best bet would be to bring it back and have them do the work.

i took the guitar in and they 'sorted the truss rod' in the process of doing it they moved the trem flush with the body, but i'm ok with that as i never use the trem..

however there was a slight buzz on the open 5th string, which is now a rattle on moderate picking which disappears when fretted... putting a small peice of paper between nut and string doesn't seem to solve it

the 5th string is fractionally lower than the sixth string at the first fret, but only by the width of the line on the steel rule.. as in the sit eitherside of the 2/32" line

I read a while ago about strings making a buzzing/ringing or rattle because of the groove in the nut, which is why it goes away when fretted. Looks like in your pic that the 5th groove isn't all that symetrical - maybe that is the issue.???

I think the strings need a nice clean 'break' as they come over from the tuning keys. Maybe you can clean the groove up a tiny bit?
