John Fogerty was sued by his former record label because they owned rights to his songs. His new ones were said to be similar, not unlike Led Zep’s woes.

Another superstar was sued by the holder of a contract for not having sounded like himself!

Song Titles: Can not be copywritten.

There are plenty of rights to be aware of and copyright is just one.

Watch out for those trademarks.
While phrases can’t be copy written they could be trademarked.
Example: “Here’s Johnny!” - Johnny Carson

Something like that for a song title may find one in court.

On the other hand . . . McDonald’s trademark “I’m Lovin’ It” is also a song by Justin Timberlake credited to Pharrell Williams, but I’m not going there, and it’s anybody’s guess how that would be approached and what the end result would be as I suppose there are two legal opinions available. I can’t and won’t say.

Percussion, it’s notation, and it’s tracks: Can not be copywritten.

It is true that copyright is not generally available in this category. Exceptions exist, but not enough to be of concern. It is reported that a specific consideration is given should it amount to being the key element in a composition that is clearly different from all others . . . but, even Wipeout has never been tested. An interchangeable combination of rudiments probably has some bearing as to the making of a composition. Here’s a pretty credible easy look for percussion copyright:

Performance rights, Royalties, Credits, Commercial use, Permissions, etc.

However, other details are to be considered before backing tracks (percussion or otherwise) are included for commercial use.

Artist and publisher agreements are usually assumed, and a few ways to reduce your risk are to use the original artist in house or online (goes without saying), more likely, software or downloads from a well established provider, a referral or option from an established source, or other similar assurance. I might say my tracks are Neil Peart’s, and they may or may not be. One thing for sure is that if they were . . . just by my saying so doesn’t necessarily mean that you or I legally have the right to use his tracks. Maybe I lifted them from another source or created them using his or another’s name to cash in. Maybe I used my name. That would be fraudulent. Not likely as he plays better. :lol:
You’ll want to do a checklist first. Just because something is free or paid for that doesn’t mean it includes that you have the freedom to use it commercially. In some cases, it doesn’t mean that you can play or use it as an upload in public. It may only be permitted for your personal use at home. You or your provider will need permission from the musician and/or the publisher who must have the permission to have and/or give this performance for the entire or partial purposes agreed upon. No more and no less.

The agreements may be limited or they may be extensive. They may be included in the initial cost or there may be an added cost to use them as desired. Some have a one time purchase for commercial use, others are a renewable subscription. It may require giving credits to the performer or companies, and it might include payments upon performances or collections. It may be none of these or all of these or something all together different. The fine print will help to clarify matters, but correspondence to the provider(s) would be a prudent approach if you are unsure. Make certain that you have a copy of the permissions should you use the material other than at home.

Chord progression: Can not be copywritten.

Good thing. A lot of 3 chord songs would have been missed by players and fans. As soon as pre-recorded OEM demo styles with tones. accents, and tempo from a particular instrument are added and claimed by those who have no ownership of the original . . . an issue can show up and has arrived in courts. You’ll want to change things for originality to prevent any question regarding a copy situation. Publishers are especially aware of this and do not take it lightly.

Riffs and melodies: Can be copywritten. Unauthorized copies can definitely be grounds for copyright infringement.

I’m no expert in copyright and I’ve found even those who claim copyright sometimes use that ignorance as a tool. Fine print, lawyers, government regulations, and good sense are your best bet. I’ve been involved with this professionally for decades and I have yet to meet a professional that knew it all unless they wrote it. Even then, the erasure comes out and new entries are made.

For some of you all of this is not relevant. As long as you play at home there will little or nothing to change. Recording, playing, collaboration, and uploading or selling compositions with these tracks may have you in this club. It’s all business with rules and regulations for you to use as you wish. The cherry pickers sometimes wait years before collecting as we have seen with major entertainers and social issues. Gone today, here tomorrow.

When I’m on my last leg, hopefully some time to come, I may sample, perform, and publish all those copywritten songs in public just out of spite. Hahaha!

Here’s a little tidbit I heard a while back. It probably holds true elsewhere. It’s been said on this side of the border that questions arose why copyright laws were not enforced as expected. The question came up in the Napster controversy, but holds true for all copywritten music. Lack of resources was the answer. The authorities were stretched and copyright was way down in the list, although not totally removed.

Remember I mentioned to expect the unexpected? Well, as the feasible story goes, industry came up with a solution. Go to the World Trade Organization and make it a trade issue. That takes copyright to a higher priority on the justice system. Where it has gone and where it will be I can’t say except that more attention by the authorities and cherry pickers shows the issue is not going away. Again, I wouldn’t worry too much, unless you put it out there and wave a flag shouting, “Here I am!” For now it remains dormant . . . at least until industry reclaims the new media (if they can with their big stick and government backing).

I’m all for fair copyright and clarity. I also think copyright laws need to be scrutinized, re-written, and shared for the benefit of the many rather than the few. A lot of copyright issues should be addressed with individual transparent contracts rather than blanket agreements. After a briefer time public domain should kick in. A lifetime copyright should not extend past one’s lifetime and it should not be a company’s or third party lifetime. IMHO.

Nice, Mike! I’m having a hard time relating to (Spring has sprung!!!) though. Here we see sprigs of grass amongst the snow and -9C/16F weather. We’ll usually jump for joy when the Centigrade temp gets double digits. :lol:

That Swing For Spring got me anxious to stretch out on the patio chaise lounge to watch the billowing clouds go by over the birds returning from their winter holidays down south. 8)
Aw shucks! There’s snow on the tarped furniture and patio, and the birds ain’t returned. :?
