Now that I'm thinking about it, I hope there are no copyright tradmark issues with respect to the band's choice of name and Tull. CC and Company have been working locally with that for quite some time now but too often, once the horizons are expanded, stuff happens. Can't use Strabismus. There's a band from Staten Island NY which copped that one.

Hee-hee - it's true! :D There's a completely different group on Facebook called Cross-eyed Mary. A single glance reveals that we're not likely to mix them up with Celtic Cyclonus' band, not by a long way. :wink:

Can't find the thread, but as it happens I believe when we were originally discussing CC's band name we talked about whether they should hyphenate it or not. Grammatically, it carries different meanings either way. CC's version is kinda angrier, which he's probably OK with...

Actually, I'm in a position to know the answer to that, beyond any doubt. There is no copyright on titles - book titles, song titles, whatever. You're welcome to name your next novel Lord of the Rings and your next album Dark Side of the Moon and nobody can stop you. It probably wouldn't be a very smart move commercially, but legally you'd be fine.

In other words, bands can name themselves after a song title without a problem.

On the other hand, there is very rigid copyright on song lyrics. Don't even think of plagarising a recognisable line or two of a song, especially if the copyright owner can afford good lawyers.

On a third hand, while there is no copyright on titles or names you can trademark a band name. I'm guessing neither Cross Eyed Mary nor Cross-eyed Mary have trademarked their names. Depending how successful they think they might become, that's a choice they could debate. Trademarking is not cheap.

In publishing there's a great story of an author who thought it would be clever to title each of his novel's chapters with lyrics from Beatles songs. The owners of the songs' copyright (not The Beatles at that time) sued for plagarism. Open-and-shut case: the author lost most of his royalties income in damages payments for breach of copyright.

If he'd known to use Beatles song titles instead of lyrics he'd have been home and dry.

My wife uses that story to terrify young writers into taking copyright seriously. 8)

A-a-anyway. Celtic Cyclonus and Cross Eyed Mary have nothing to worry about.
