Hi again Dinosauria:

Those laws work both ways, as long as I have a warranty I can get it fixed as is my right, however as a warranty is in place with and the repair has to be carried out by Fender/Squier it's up to them to put it right.

So in effect because I have a route to get it fixed by Fender and the shop itself cannot carry out the repair the store has a loophole to pass the problem onto the manufacturer Fender, so in effect by not returning any email requests or offering a way to contact them directly legally Fender are actually the ones who are not adhering to trade laws in the UK.

Respectfully, no: this is all incorrect.

Here, familiarise yourself with this page:

http://www.direct.gov.uk/en/Governmentc ... /DG_194650

All of that is not someone's opinion, it is Trading Law.

The shop does not have a loophole and this law does not work both ways. The shop has to either repair or replace the goods. End of story.

In real life what usually happens with a faulty neck is Fender supply a replacement which the shop's tech fits for you. Without the slightest disrespect to the Squier line the cost of that exercise may not be worth it to them at this price point and they may feel it preferable to simply replace the guitar. But that is between the shop and their Fender rep to work out, it's not your problem.

Tell us who the shop is. Are they a music shop or one of the many other general-type retailers who also sell Squier guitars? If so, they may be forgiven for not knowing the ropes on dealing with Fender - but that doesn't get them off the hook.

Read that webpage I linked to, then go back and politely request them to put the matter right. If they won't, well that page tells you what to do next.

And again, I also strongly recommend you speak to the credit card company about their purchase protection scheme. They get very tough with retailers over this stuff in a way that works out expensive for the shop. Once you are forearmed with that extra knowledge you will have further ability to talk persuasively with the shop's manager/owner.

Good luck - C

Hi Dinosauria: I absolutely concur with my esteemed fellow forumites. Them twisting definitions ("repair necessary") is an attempt to get out of it. Don't let them. This is nothing that can/should/needs to be "fixed" as in repaired. It is faulty. It needs replacing.

And if need be, you gotta ring the bell, blow the whistle, and so on.

Take a look at this bloke, draw a breath of fresh air and enter round two! You can do it!

Follow the advice on the page Ceri linked.
If you follow the links to other ages, it is essentially a step by step guide for what you need to do.
A lot of shops rely on people being confused as to their right, and that a lot of people will give up if they prolong the process.

Ceri why are your government web pages hosted in Canada?

I use an add on on my browser that tracks the server locations of any IP's, seems a lot of UK content is hosted in Canada, for instance the SUN (and the page 3 pictures,) are hosted in Canada.

Well how fascinating. Then I wonder if my previous flippant suggestion might actually be the real answer? One thing we know about huge servers is that a significant part of the cost of running them is cooling. I've heard of them being placed next to lakes or rivers to use the abundant cold water for that purpose, and I guess if you site them far north in chilly climes that helps too.

Has Canada carved itself out a useful niche market providing servers? After all, it's a safe, stable, friendly country that everyone feels they can trust. At the right price I guess most of us would be happier to put our data storage there than certain other places we can think of. And to be sure, your country and mine have especially good relations. I'm sure you'll look after our Trading Law website responsibly!

Countries often turn out to have cornered unexpected specialist markets. Norway holds one of the two global bio-data-banks (again for temperature related reasons); out-of-the-way Finland leads in various wireless technologies; Iceland has a big aluminium smelting industry; and here in the UK we print bank notes for about half the countries of the world. Oh, and Ireland manufactures all the viagra for the whole planet: that one always tickles me for some reason.

...I'm rambling aimlessly till Mr Dinosauria comes back to tell us how he's getting on with his cussed guitar vendor. :)

Cheers - C
