The BBB is a private, non-enforcement agency. You'd do better to contact the local government's Dept. of Consumer Affairs which covers the seller's jurisdiction.

I've been in your situation before. I called the seller's establishment and got the usual snow job of him being unavailable. I stated to the person who answered the phone that if I don't hear from the owner within a half hour, not only was I going to call Consumer Affairs, but I was going to take him to court. He called me back in 5 minutes and did the 'right thing'.

The BBB usually will just document the case and not do anything about it. Just keep calling mutliple times each day. I would send them a certified letter with a required signature as well. This way, if it ends up going further, you'll have it documented that you attempted to contact them early on. Just keep being a pest. If it's a corporation, just keep escalating to the next level. Eventually, you will get somebody on the phone that does not want to be bugged with such minor issues and will likely take it out on everybody that let this go so far.

If this shop is in Charlotte, NC... I'll go over there and yell at them for you! :lol:

Unbelievable... this is the response I got today.

These aren't "swirl" marks left over from finishing since I can feel actual scratches on the surface, and those kind of marks wouldn't account for the scratches on the neck plate either. Again, this guitar was sold to me as "new" from an online retail store, not an individual. I was told the guitar had never been displayed on the sales floor.


Yeah, those are not swirl marks those are scratches! I would demand a refund or replacement. Don't leave the bastards alone until they make it right... :x

To be fair, they have offered to refund the purchase price of the guitar but are unwilling to refund the shipping I had to pay for delivery and return because of their defective product. So far, Rick (the owner) seems unwilling to file a Fedex damage claim as he has not acknowledged this solution even though I've suggested it in several emails. I can only assume they didn't purchase shipping insurance.

Unfortunately most big companies don't purchase shipping insurance. The volume of shipments that arrive safely far outweigh the number that don't. So in the end, the companies save money by not taking out insurance. I think I know which sight you are talking about and I am going to ask. Please feel free to not confirm if you want. But I think it is musicmachineguitars.com, isn't it?

Mods, If I am violating some kind of forum rule, please let me know. But I think you should also know that one of your authorized vendors is not honoring to pick up the shipping costs on damaged goods. Do you really want to have them represent your fine company with a long history of quality and customer service?

A "brand new" guitar should not even have a finger print on it, get your money back asap. A friend of mine bought a guitar from Musicians friend and when it arrived the case was banged up. He called right away and they bent over backwards to make it right. He received a new one 3 days after he contacted them and was not responsible for the shipping. Please let us know who that on line retailer is so all of us here may not fall victim to their crappy customer service.

I would tell them you are ready to file a complaint with the FTC and the FBI (WIRE FRAUD charges), as well as your local police (also wire fraud..selling used items as new...thsi guitar was obviously NOT new...I would also tell the owner that you will go to your local TV station for a story on irreputable businesses...that should get their attention

First of all, I deal with a dealer/on line and in store. When I have a problem with any purchuse, I tell them. They will check your file/history and products you bought. They will see your a good customer and will do what they can to keep you coming back.

I called Fender customer service today and related my experience to the agent I spoke with. He was apologetic that I had been subjected to such poor treatment, but told me that my dispute was between the dealer and myself and they could not intercede. I can understand why that would be the case. I still believe the onus rests solely with the retailer to correct this.

All this trouble has taught me a worthwhile lesson: I'll never buy another instrument online. I'd drive 1000 miles to buy a guitar in person before I order anything sight unseen.

I'm glad to say that after much debate with the owner via email (never actually spoke to the gentleman) that the price of the guitar and all shipping costs were refunded to me.

Write a letter of complaint to their corporate office and keep elevating. If you are dealing with a call center then they don't want a repeat caller (if the center is worth anything they would value resolution)
