I went in today to talk to them. I told the sales lady about the price issue I have and she pretty much told me she would cut me a deal.
So basically I will be buying the guitar for less then $399 but the price has yet to be determined. She said she would let put it on lay away in the back for no extra charge.
As for the it being a second, I looked hard for about 15 minutes and found one thing that could possibly be it. On the front of the guitar there are four hairline streaks that go about 1/8 of an inch and are silver. It looks like a weird acrylic type paint or something. There are also some sticker marks on the pickguard and the pickup selector switch has some marks on it.

Overall it is a nice guitar. From what I can tell it appears to be a Honey Burst but in my opinion it doesn't really burst.

Well...it does look very nice (and I also believe that is Honey Burst), I know you've looked it over, but I'd still give another thorough check before putting money down on it. If you're comfortable with it and everything seems good, it looks like a nice guitar.

Yes I will definitely have to really check this guitar out again. They're getting a shipment of Gibson and Epi's later this week, so the lady told me to come back and check out the 2011's to make absolutely sure that is the one I want. Such great customer service there

Yep Honey Burst very nice I used to have a classic LP in Honey Burst, they are pretty not a rare color though.
