Get prenups before you record with anyone and copyright your work.

Ok so I'm no legal expert but here is one situation I know of with a similar situation.

This is the recent "Best Of" compilation from Reel Big Fish released this year, however their old record label Jive Records own the master copies of all their songs, so to make this they rerecorded the songs again to use on this album.

Now they're a relatively big band, and if they can do it I don't see why you should have a problem.


Again I stress I'm no lawyer but seems like a relevant situation.


Also I thought that as you are the original author of the song then it is in fact copywritten to you automatically and it was never his property to record anyway. Although to take that to court I think you would then have to register it.

If you hold the copy right you own the song! Every song I wirte gets copy righted prior to letting anyone listen to them. When I took my copyright law classes in college there were tons of cases like you are explaining and unless he copyrighted the original COMPOSITION you own the song. IF he copyrighted the recording then he is right you can not use the original recording...

Do what any Kiwi/Australian would do and just wing it & run with the ball like you were being chased by the cops. Was the song copyrighted? no? just do it anyway :lol: :wink:

You gimme that whale song you did, and ill lay a malmsteen blister speed shred over the top and Ill split the proceeds with you both ways. Ill even share a slab with you. You can't get anymore fairer than 50/50. :wink:

My original compositions are on cassette. Thanks for your help advice. Get written agreement about who can promote the recording master, especially if people go their own way. A good clause to remember is '' any songwriter in this recording can promote the song ''

Wonder if he has done this with other bands invited to his studio added bit's then taken all the credit, seems he may well have had some dealing's with the legal side of recording / copyright issues, commonsense and legalities don't mix well in some instances to me but in this case commonsense should prevail, the composer of the original composition has sole right's to do with his composition whatever he feels..................jury dismissed, case closed, Next :)

Hope you get some peace with this Vinny don't let it twist you up, maybe use it to write the next No1 worldwide hit then sue the f...in a.. hole for long long time you like :wink:
