Post subject: calling Mondo Phrygain add M3rd

I have been working on a song, its a old song that I don't know the name of. Anyway, It appears to use E phrygain licks between e major and a minor chords. What confuses me is that periodically it tosses in a major third. This would lead me to believe it was using E phrygain dominant, but it also uses the flat third. My question is; is it common to mix these two together? Would you call it Phrygain add M3rd? Since your keeping the flat 3rd as well.
This is Spanish guitar style by the way.

OK, further study leads me to believe this may be a passing note, like a blue note except for phyrgain, that builds tension. It is part of the E major chord and when toggled between the M3 (or b4) and b3 it is the same affect as moving the major E chord up a fret and back down while strumming. That may be where it comes from. Any insight would be appreciated.

Well if someone has done it and made it sound good, then obviously it's ok to do it. (Tools not rules, back to that whole ear over theory thing).

What style is the piece, 15thC spanish catholic mass inspired, gypsy jazz?
