Post subject: Logos, Legality, and Second Hand Markets

Greetings fellow guitar enthusiasts. I am in an interesting point currently, I like to create new custom art guitars at home. I want to put my own artist signature and mini logo on it. (non registered logo not associated with any LLC or Co. just a personal logo i designed.)

I am having a bit of an issue with an idea though. I have a guitar I assembled from parts all over the internet and did a custom drawing on it, and now i want to sell it. The headstock is shaped basically just like a fender telecaster however it is blank with no logo. I purchased this neck from Stewmac.com ... I want to apply a waterslide decal to my guitar with my own logo on it.

Here are the examples of the guitar I have built. Basically my question is, is this legal to now apply my logo on this headstock here? I understand it is a telecaster shaped head , but i purchased this head from stewmac.com , and the body was second hand from guitarfetish.

Hi, thank you for referring me to this post. I read all the posts on there and they "appear" to be saying that as long as I dont market it as a fender stratocaster then it is fine, however in the post they specifically referred to putting fender logos or gibson logos on their guitars, as where im taking fender tele shaped necks and putting my own logo on them.

also I guess my new concern is, would I be legally able to include the words "telecaster" or "stratocaster" in my selling title if i dont refer to them as fender telecasters or as fender stratocasters?


Im planning to sell them on ebay if i am able to

It's Stratocaster®, Strat®, Telecaster®, Tele®; you get my drift.

We all know the problems with fakes, so I'd suggest you figure out a way to stay really clear of that sector.
Just an idea: why not use second hand MIM's as the base for your projects..?

There are people on EBay who sell Strat/Tele style bodies and necks all the time along with Stewmac and Warmoth. I would think you'd be okay as long as you don't say or imply that the guitar is a Fender or some kind of "authorized" or licensed reproduction.

I got a Strat clone on EBay where the seller matches inexpensive off-shore bodies (solid colors only) with US made necks (good quality and fretwork). There's no logo on the headstock and the seller only says in his listings that they're not Fender or Fender-authorized guitars. My guitar tech (in business since 1996) told me about Warmoth when I needed a replacement neck for my Fender Jazz Special. He said they come with no logo and as long as I didn't try to paste a Fender logo on or pass it off as all original, no legal problem.
