Misinformation is bad. Online forums are breeding grounds for pathogenic misinformation, especially this wide-spread bug that makes people say, "well, I don't know anything about the music business, copyright law or trademark violation, but my FEELINGS on the subject should be good enough."

Well, they're not. Courts don't care how you feel, what your intentions were, where your head is at. They only judge behavior. Now, I am harsh on this crap, because I own some IP. So I think trademark and copyright violators need a hard punch in the face every day, and I don't care whether some of them are your friends and they're real nice guys and promised they'd NEVER try to fool anybody, so it's okay.

It's also illegal to not come to a complete stop at a stop sign. It's also illegal to run a stop light. It's also illegal to drive 4 miles over the speed limit.

Let me guess...

You've never done any of those things right?

Bottom line is that through the legal channel you would have to submit the following through your local Fender authorized dealer:

1. A written request,...stating the specific decal you need and the
reason you need it.


2. A photograph of the entire front of the instrument.


3. A photograph of the entire back of the instrument.


4. A close-up photograph of the headstock of the instrument showing
the need for a new decal.


5. If the serial number is on the neck plate, send either a close-up
photograph of the neckplate or a lead pencil rubbing of the neckplate
serial number.

Or you can google it up and find repro decals from places like bigdecal.

Yes using fake Fender logos is wrong and Fender has a right to prosecute anyone who does. Will they actually go after someone for just one fake logo? Probably not, but this does not condone the illegal activity. I understand all that....

I know trademark infringement is not cool, its not legal, and should not be tolerated...

We are just two very opinionated individuals. No amount of Latin and legalese is going to change my opinion on the matter, and whatever I say will not change yours. As I said in one of my first posts, its my opinion, and you have yours...and we both have a right to our individual opinions no matter how right or wrong, or legal or illegal, you may think someone else's opinion may be, they still have a right to their own opinion. And I am not some misinformed kid on the internet who does not know anything about the music industry. I am 33 years old, have worked in commercial radio for 10 years, have worked in various areas of the music industry for more than that, and have various intellectual property legal issues and matters as well, so I understand the importance of copyright and trademark laws. I just happen to have a difference in opinion, and yes my opinion may not be legally valid, but thats the difference between fact and opinion. Opinions do not need to be substantiated by facts, and I still have a right to my own opinion, no matter how much anyone or the law may disagree with it. And just because I have an opinion that violates the law does not mean that I always violate the law, I just have an opinion that differs from the law, even though I may obey it for the most part...

So my opinion is, 1 or 2 fake Fender logos for something other than resale is relatively harmless, though while in my opinion harmless, it is still illegal, and the fact is, it can be prosecutable. I get it. Would that stop me if I wanted to put a Fender logo on something, probably not. Thats why my house isn't glass, because I will occasionally bend the rules and/or disregard authority...but who doesn't?

Also, Fender monitors this forum more than you might think or realize, and will make their input known if they feel their input is needed.

Anyone confused as to why this would be a sensitive topic 'round these parts just isn't really thinking it through from all angles.

That said, just to confirm some statements already made earlier in this thread, we DO actually have an official support policy for this. Here's the relevant text direct from our support FAQ:

Is it possible to get a replacement decal for my old Fender instrument?

In many cases, the answer is "YES!" To help us achieve the best match of available decals, take at least 4 clear photographs of your instrument, (the entire front, entire back of the instrument and a close-up of the front and back of the headstock). This will help us verify that it is indeed a genuine Fender product in need of a replacement decal, (if the instrument has the serial number stamped into the neck plate, please include a pencil "rubbing" from the neck plate showing this number).

Next, take the photos along with your guitar to the nearest Authorized Fender Service Center, where they will evaluate the instrument. After comparing the instrument with the photos, they will then mail the photos and neck plate rubbing to our Product Support team in Scottsdale. Once we receive the photographs, we will try to find the most accurate decal for that instrument. We will then send the appropriate decal to the Authorized Service Center. Note: Decal availability is limited to certain models, and while Fender does not charge a fee for a replacement decal, the Fender Authorized Service Center may charge a fee for providing this service to you.

Brad is that service available outside of the U.S?
If so, so's not to fall foul at a later date i'll snap the guitars now. In the event of a accident there will be before and after pictures then.

Brad,

this will probably be a stupid question lol but im asking anyways. Does the logo have to be the exact same one that came off of the neck. I was looking at a fender jag and a 68 strat neck both look identical to me, but i dont have 900 bucks or more that ebay sells them for to get just the strat neck i am looking for. However the jag is around 300 or so, if i refinished the neck would i be able to take it to a dealer and get a strat decal on it. Lol i know that probably is the dumbest question ever but, but in the military i am always told its only dumb not to ask. Id even be willing to buy that decal if needed.

I see both necks being exactly the same just different decals.

after trying to figure out the best option and talking with fender and warmoth i decided on my own logo for my aftermarket neck keeps things legal and i dont have to worry about it.

let me know what you think, decals will be here friday so the quality is going to be way better, but here is what i came up with. And both warmoth and fender are ok with it.

i get the neck i wanted for about 900 to 2000 cheaper then ebay and i think it looks alright.

what do you want it to say? lol i wouldnt say a work of art its ok but i appreciate the compliment. I tried to get it as close as i could to the Fender logo style but fender approved i sent the picture to jeff krause and he said it looks good to him so lol

Its a licensed neck with my custom work on it everything else is fender the body pickups are going to be changed to blackouts but everything else is fender.
