If you have early breakup power tubes it might do that. You may need a set with late breakup!

Is your foot switch plugged in? I had a similar problem and thought my amp was ready to go. I unplugged the foot switch (it must have been faulty) and no more issue.

Just to compare with my BDLx (clean channel is almost the same): even with my Washburn Hawk, which is the most powerfull guitar I ever have, It doesn't distord at 2~3, even with itinial bias at 60mV. If the bias is correct, your amp is still under warranty, request a exchange.
